Filing for Bankruptcy a Second Time

Many people are unaware of the laws regarding filing for bankruptcy a second time. If you have filed for bankruptcy in the past and have again found yourself in financial turmoil, you do have the option to file for bankruptcy a second time. In fact, there are no specific limits or rules regarding how many times you can file for bankruptcy in your lifetime. There are only restrictions on how often you can file.

Other than time restrictions, filing for bankruptcy a second time will follow many of the same procedures as an initial bankruptcy filing. However, there are things that make every bankruptcy different, so you will still want to secure legal help before filing.

Time Restraints for a Second Filing

There are very strict and specific time restraints regarding how often you can file for bankruptcy, and these differ based on the bankruptcy chapter you are interested in. After getting documentation from the court to see the exact date you last filed for bankruptcy, you can see if you are eligible to file again.

If you filed for Chapter 7 bankruptcy on your first filing you:

  • Have to wait eight years to file for Chapter 7 again
  • Have to wait four years to file for Chapter 13

If you initially filed for Chapter 13, the time restrictions are:

  • Six years to file for Chapter 7
  • Two years to file for Chapter 13 again
