Student loan laws may be adjusted

Bankruptcy codes may be adjusted for individuals who default on student loans. According to a report from the House Judiciary Subcommittee on Commercial and Administrative Law, the committee members are considering a change in bankruptcy law that would help student loan borrowers. 

The chair of the committee announced the proposal, claiming that the current law gives an unfavorable preference to lenders. The potential new law would protect borrowers from risky loans and predatory loaning practices.

Arizona mortgage service firm acquires new software

A mortgage service firm acquired software for high-volume loan processing as a result of a bankruptcy trial in Arizona. Caliber Funding, which is owned by Lone Star, purchased the software in First Magnus Financial Corporation's bankruptcy case. 

The purchase was made directly from StoneWater Mortgage, which is the informally reorganized entity of First Magnus. A spokesperson for Caliber Funding said the software will allow the mortgage service firm to better compete in today's mortgage enviornment.

Homebuilder files for personal bankruptcy

The CEO of Montalbano Builders Inc. filed for personal bankruptcy last month, according to bankruptcy filings for a U.S. Bankruptcy Court in Chicago. Homebuilder Anthony P. Montalbano Sr. listed assets of less than $10 million against liabilities of more than $100 million.

One of the largest creditors named in the lawsuit, RBC Bank, claimed that Montalbano defaulted on loans last year and filed a foreclosure lawsuit against him five days after Montalbano's filing. Two of the towns in the RBC Bank foreclosure lawsuit were the Arizona cities of Peoria and Coolidge, according to RBC's attorney.

Phoenix Coyotes receive competing bid offers

The Phoenix Coyotes could be purchased by the beginning of next week. The team, which entered bankruptcy four months ago, received word from a U.S. bankruptcy judge that he will no longer consider the possibility of throwing out competing offers to buy the teams. 

Two months ago, Canadian billionare Jim Balsille offered to buy the team for $242.5 million, as long as the team is allowed to move to Ontario. The deal is also contingent on NHL approval, which many experts predict will be granted.

Asarco receives competing bid from Sterlife

Asarco LLC, which has been operating under bankruptcy protection, received a bid offer from Sterlife Industries Ltd. Friday. The Arizona mining company had previously received an offer from Gruop Mexico.

Sterlife bid $2.57 billion for Asarco, which will provided needed cash for payments to asbestos creditors. The competing offer followed a ruling two weeks ago from a U.S. Bankruptcy judge that recommended that Grupo Mexico be allowed to take control of Asarco.
