Relief of tax payments in bankruptcy filings

by Administrator 30. October 2009 00:38

While many people who file for bankruptcy are required to pay their taxes, they may be able to receive relief of some tax payments. However, this relief is often granted in few cases and limited circumstances.

In Chapter 13 bankruptcy, a person may be able to pay off a tax lien if the claim is secured, and may be able to discharge the debt of unsecured claims.

In most cases, people who file for bankruptcy may also be eligible for tax carrybacks and carryforwards, which could significantly adjust their tax liability in current and future years.

How an automatic stay wards off creditors

by Administrator 30. October 2009 00:24

People who file for bankruptcy often enjoy the benefit of the automatic stay. This legal mechanism restricts creditors by not allowing them to take action against a debtor unless the creditor receives permisssion from the bankruptcy court.

The automatic stay is intended to give a debtor the time and ability to renegotiate his or her debt. However, in some circumstances, creditors can receive a special grant from the court, which allows them to collect debt payments.

State provisions for bankruptcy laws

by Administrator 23. October 2009 03:23

While many people refer to federal bankruptcy laws, bankruptcy filers are also subject to state bankruptcy laws. These laws often deal with debt and other limits for filing under each type of bankruptcy.

The state provisions can also  include restrictions on reorganization plans, liqidation ability, and certain exemptions. Given the variations between states, many bankruptcy filers have tried to move states in order to receive more favorable bankruptcy protection. However, a 2005 federal law has made this more difficult for most filers.

The importance of retaining a job to improve your credit score

by Administrator 22. October 2009 08:07

One way for people to improve their credit score is to stay at the same job for a long period of time. Creditor's assess the longevity of a person's career in order to determine that person's ability to repay a loan.

For instance, if a person holds a job for many years and receives a steady income, indicates to lenders that the person will be able to repay a loan. However, if the person has changed jobs frequently and that person's income has varied significantly, then lenders will see that person as a risky borrower.

If you are considering renegotiating your debt, contact the Arizona debt negotiation lawyers of the Harmon Law Office at 480-829-0494.

The difficulty of filing for bankruptcy during divorce

by Administrator 15. October 2009 04:49

One particular challenge in a divorce is a bankruptcy filing during the divorce process. While most couples file for bankruptcy before the divorce to simplify things, some do not have that option and must wrangle out the communal and individual debts in court.

When a couple decides to file for bankruptcy during divorce, certain types of property are eligible to pay off the debt. One type is community property, which is property acquired by both parties during the marriage. A few exemptions apply to the community property rule, but these exemptions vary by state.

If you are in the middle of divorce proceedings and considering filing for bankruptcy proceedings, contact the Arizona bankruptcy attorneys of the Harmon Law Office at 480-829-0494.

Foreclosure rates rise in Arizone, across the United States

by Administrator 15. October 2009 04:40

Foreclosure rates rose in September, a sign that the recession is still affecting real estate. According to data fom ForeclosureListings.com, the foreclosure rates in Arizone were the highest at 36.1%.

The high foreclosure rates, however, were coupled with high foreclosure sales rates, which signals that home purchases may be on the upswing. Despite the increased foreclosure sales, the more foreclosures signals that homeowners in Arizona are still struggling to make mortgage payments.

Because mortgage payments often represent a large expense for most households, one solution for households struggling to make debt payments is debt renegotiation. If you or your family is considering debt renegotiation, contact the Arizona debt negotiation lawyers of the Harmon Law Office at 480-829-0494.
