According to Arizona governor Jan Brewer, the State of Arizona is facing its "the worst financial days ever."  The state is up against a $1.5 billion defecit this year, and is expected to face a $3.4 billion shortfall over the next fiscal year.  Arizona state lawmakers passed a new bill recently which cuts about $193 million from the state budget, mostly cutting state salaries and benefits.

What is the Mean's Test?

The Mean's Test is a formula that bankruptcy courts will use to determine whether the debtor has enough income to pay off certain expenses. One of its purposes is to ensure that high income individuals from filing for Chapter 7.

The formula is highly complicated, but it is also generous for many potential bankruptcy filers. The mean's test, however, is only permitted for personal bankruptcy filers and is not used for businesses.

Can a bankruptcy court discharge student loans?

When individuals file for bankruptcy, some of these individuals may have a number of student loan obligations. In most cases, these obligations will not be discharged by a bankruptcy court.

When this occurs, the person filing for bankruptcy will be forced to pay off some or all of the student obligation. However, in rare cases, the individual may be able to discharge the debt. This provision is allowed if the individual can who "undue hardship."
