Can you pay off your debts after you file for bankruptcy?

Many individuals file for bankruptcy for the purpose of discharging some of their debts. However, this does not mean that bankruptcy filers cannot repay some of their debts. 

In some cases, individuals choose to repay some debts so that they can keep valuable assets like cars. The voluntary repayment of assets does not include debts that are part of the Reaffirmation Agreement, which bankruptcy filers are required to repay.

Can a bankruptcy filing discharge out-of-state debts?

Individuals file for bankruptcy in courts located in their state jurisdictions. However, this does not mean that the bankruptcy court can only discharge in-state debts. 

Because bankruptcy is a federal proceeding, U.S. bankruptcy courts have the authority to discharge debts owed in any part of the country. For this reason, bankruptcy filers are typically required to list all of their out-of-state and in-state debts.

How will your income affect your bankruptcy filing?

When individuals file for bankruptcy, bankruptcy courts will determine their ability to repay debts based on their past income. This calculation will often use individuals' average incomes over the past six months.

Some filers complain that this method is unfair because many individuals file for bankruptcy after they lose a job. Based on this reasoning, they no longer have the same income to repay their debts.

Is a bankruptcy filing public information

When individuals file for bankruptcy, they are often worry about their reputation. They typically hope that their family, employer, or others will find out about the bankruptcy.

Bankruptcy filings, however, are public record. This means that they can be accessed by anyone, including creditors. In most cases, though, others will not go to the trouble to try to access these records and they will not be discovered by others.

Can creditors continue to harass you after a bankruptcy filing?

Once individuals file for bankruptcy, they are afforded many protections. One of these protections is a requirement that creditors stop harassing bankruptcy filers. 

In most cases, this menas that creditors cannot contact filers about payments or initiate any lawsuits. However, some creditors like banks may keep a lien on a car until the payments are made.

Arizona bankruptcy filing rise in January

Bankruptcy cases rose 45 percent in January compared to the same time last year. According to statistics from the U.S. Bankruptcy Court of America, 2,493 bankruptcy cases were filed in January. 

The rise in bankruptcy filings was likely the result of a number of factors related to the recent recession. With many people losing their jobs and others having their home values drop, many people were unable to keep up with their regular debt payments.
