What to expect when filing for Chapter 13 bankruptcy

by Administrator 1. August 2011 07:29

If you are struggling financially, you may not know where to turn for the relief that you need. Bankruptcy protection can offer valuable help to those experiencing financial difficulties, and many people find relief in Chapter 13 bankruptcy.

Chapter 13 is a consumer bankruptcy option that helps a person emerge from debt without losing valuable assets such as their home or car. This type of bankruptcy protection involves reorganizing a person's debts so that they can be paid off over the course of three to five years.

A person who is going to file for Chapter 13 bankruptcy must prove in court that they have a regular income that they can use to make payments on their debt.  Many people choose to file for Chapter 13 in order to protect theselves from foreclosure, wage garnishment, or repossesion because once a person files, an "automatic stay" is activated. This means that creditors can not file lawsuits or harass debtors.

Advantages of filing for Chapter 13 bankruptcy

by Administrator 16. May 2011 04:42

When filing for bankruptcy, it can be difficult to know which bankruptcy is the right one to choose. Chapter 13 bankruptcy can be very beneficial to someone who would like time to reorganize his or her finances while still retaining personal assets.

Chapter 13 bankruptcy has many advantages. One such advantage is that Chapter 13 bankruptcy allows the filer to avoid foreclosure on their home. Chapter 13 bankruptcy can stop a foreclosure in its tracks and allow the filer to have time schedule payments. Known as an automatic stay, stops are put on foreclosures and collection efforts made by creditors, so that bankruptcy filers can retain their assets.

Another advantage of Chapter 13 bankruptcy is that it can help eliminate a second mortgage, if the value of the home has depreciated to an amount less than what was owed on the first mortgage. This can be a huge help to homeowners who are struggling with two mortgages.

Financial Troubles Force Designer to Retract Bankruptcy Filing

by Administrator 11. April 2011 05:21

The former interior designer of Dr. Phil was recently forced to retract a Chapter 13 bankruptcy filing. The woman filed for bankruptcy last November in an attempt to reorganize her finances and pay off her debts. However, because of a lawsuit that she filed against Dr. Phil, the woman found herself unable to pay off any of her debt.

The woman's case against the talk show host was stalled by her filing for bankruptcy. An attorney who is representing the woman stated that Dr. Phil's legal team drained her finances with confounded litigation, and she was forced to choose between the bankruptcy filing or continuing her lawsuit against Dr. Phil.

Reports have said that the woman may lose her car because she was not able to file bankruptcy.
