Can a bankruptcy filing discharge out-of-state debts?

by Administrator 23. February 2010 06:34

Individuals file for bankruptcy in courts located in their state jurisdictions. However, this does not mean that the bankruptcy court can only discharge in-state debts.

Because bankruptcy is a federal proceeding, U.S. bankruptcy courts have the authority to discharge debts owed in any part of the country. For this reason, bankruptcy filers are typically required to list all of their out-of-state and in-state debts.

If you or anyone you know is considering filing for bankruptcy, contact the Arizona bankruptcy attorneys of the Harmon Law Office at 480-829-0494.
