Can bankruptcy filers recover their tax refund checks?

During the time of a bankruptcy filing, individuals often are unable to recover part or all of their tax refund checks. Once they receive these checks, they are often required to turn over the check to their trustee.

In some cases, bankruptcy filers may be able to recover a portion of the tax refund check, especially if the amount is relatively small. However, most individuals should expect to give up their tax refund check.
